Arbitration is the most formal Alternative Dispute Resolution (ADR) process. In arbitration, instead of the parties bargaining with each other, a neutral arbitrator decides the outcome. Parties in arbitration agree on certain rules to govern the process. Similar to a court proceeding, parties plead their case in an arbitration session, hoping for a favorable decision. Like a judge, an arbitrator makes decisions about evidence and gives an “arbitration award” which is generally binding on the parties.
