Mediation is the most popular form of Alternative Dispute Resolution (ADR). Mediation simply stands for “mediated negotiation.” In mediation, each party meets with a neutral third-party expert known as a mediator. DMS may assign more than one mediator for some cases. The mediator(s) facilitate dialogue with each side in the hopes of reaching a mutually satisfactory resolution to their conflict. Mediators may also assist the parties in putting their settlement agreement in writing. If the parties do not reach a settlement, they still have the option to file a lawsuit. At DMS, each party in mediation will have the opportunity to be heard. Mediations are not subject to formal rules of procedure, thus parties may bring any relevant evidence to a mediation session. Communications in mediation sessions are confidential. Mediation sessions generally take only 2 to 4 hours. In addition to this traditional form of mediation, DMS also offers fast-track mediation which allows parties to participate in mediation at an earlier stage of the litigation process. |
